July 29: An Act Written Just for Moi??

This will only be the second year of The Nation's Triathlon race. Last year, it turned out that the innaugural triathlon wasn't really that. In fact, it was only a dualathlon. Why? Because the race powers that be weren't able get a permit in time for the racers to swim in the Potomac River. So much for the swim; the race ended up being a Run/Bike/Run. Glad I wasn't there last year!

Will this year be different, and in fact be a true triathlon? The answer is YES. Legislation was passed recently by the DC Council legalizing the swim for the triathlon, which means that the DC authorities may now issue the permit and are expected to do so in a timely manner. A copy of the official act is as follows:

The DC Triathlon Act of 2007:

BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may be cited as the “Inaugural D.C. Triathlon Emergency Amendment Act of 2007”.

Sec. 2. Section 1158.5 of Title 21 of the District of Columbia Municipal Regulations (21 DCMR § 1158.5), is amended to read as follows:“Primary contact recreation shall be prohibited in the Potomac and Anacostia Rivers and Rock Creek until such time as the standards in subsection 1104.8 for Class A beneficial use are consistently maintained, except that swimming shall be allowed on September 29, 2007 by those persons who are registered participants in the triathlon organized and hosted by The Nation’s Triathlon, LLC, in those areas of the Potomac River designated for the swim portion of the triathlon and in no other areas. In the event that laboratory examinations of samples collected prior to the date of the triathlon suggest to the Director that swimming in the Potomac River should be prohibited on September 29, 2007, the exception contained in this subsection shall not apply.”.

Sec. 3. Fiscal impact statement.

The Council adopts the fiscal impact statement provided by the Chief Financial Officer as the fiscal impact statement required by section 602(c)(3) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 813; D.C. Official Code §1-206.02(c)(3)).

Sec. 4. Effective date.

This act shall take effect following approval by the Mayor (or in the event of veto by the Mayor, action by the Council to override the veto), and shall remain in effect for no longer than 90 days, as provided for emergency acts of the Council of the District of Columbia in section 412(a) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 788; D.C. Official Code §1-204.12(a)).


Now that the act is in place, organizers took no time to apply (and get) the permit (below). Now the only reason why we won't swim on September 29th is if Mother Nature doesn't cooperate!
